1. Acceptance of Terms

By accessing or using Kitsunic Works ("we," "us," or "our") website and services at kitsunic.org (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Kitsunic.org is a social networking platform that allows users to create profiles, share content, communicate with other users, and participate in community features. The Service is provided free of charge unless otherwise specified.

3. Account Registration

  • You must be at least 18 years of age to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current, and complete information during registration.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Ownership

You retain full ownership of all content you create and submit to the Service ("User Content"). By posting User Content, you grant Kitsunic Works a limited license solely to display, store, and transmit your content as necessary to provide the Service — for example, showing your posts to other users, storing your photos on the server, or delivering your messages. We will not use your content for advertising, remix it, or distribute it outside the Service without your permission

4.2 Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the right to post all User Content.
  • Your User Content does not violate any third party's intellectual property rights.
  • Your User Content complies with applicable laws and these Terms.

4.3 Content Moderation

We may remove User Content that violates these Terms. Where practicable, we will provide the user with written notice explaining which content was removed and which specific term it violated, and an opportunity to contest the removal. In cases involving immediate harm (such as malware, non-consensual intimate content, or doxxing), we reserve the right to remove content first and provide notice after.

5. Acceptable Use

You agree NOT to use the Service to:

  • Post, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Upload or transmit viruses, malware, or any code of a destructive nature.
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service.
  • Use the Service for any commercial purpose without our express written consent.
  • Harvest or collect personal information of other users without consent.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Create multiple accounts for the purpose of harassment, evasion of moderation, or spamming.
  • Share another user's private information without their explicit consent (doxxing).

6. Intellectual Property

  • The Kitsunic Works name, logo, and branding are owned by Kitsunic Works. The social networking platform powering this Service is based on Open Source Social Network (OSSN), which is licensed under the GNU General Public License v3. Custom modifications, themes, and components developed by Kitsunic Works for this Service are owned by Kitsunic Works.
  • You may not use our trademarks, logos, or branding without prior written consent.
  • If you believe your intellectual property rights have been violated, please contact us with the relevant details.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and disclose your personal information.

8. Third-Party Links and Content

The Service may contain links to third-party websites or services that are not owned or controlled by Kitsunic Works. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
  • THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE.
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITSUNIC WORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Responsibility for your Actions

You are responsible for your own conduct on the Service. If your actions result in legal claims against Kitsunic Works — for example, posting content that violates someone else's rights or breaks the law — you agree to cover any resulting damages, losses, or legal costs. In short: you break it, you own it.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Account Termination

We may terminate or suspend your account if you violate these Terms. Except in cases involving immediate harm to the community (such as malware distribution, doxxing, or illegal content), we will provide written notice explaining the reason and give you a reasonable opportunity to address the issue before action is taken. You may also close your own account at any time by contacting us.

These Terms shall be governed by the laws of the State of Vermont, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Vermont.
